Firearm Mentorship Network ("FMN") — https://firearmmentorshipnetwork.com
This agreement is between Firearm Mentorship Network ("FMN") and the individual or entity accepting this Agreement ("Instructor").
1. Purpose and Incorporation
This Instructor Agreement ("Agreement") sets the terms on which you may list yourself and your courses on the Firearm Mentorship Network platform (the "Platform") and connect with Participants. It supplements the Terms of Service, Privacy Policy, Safety Policy, Professional Code of Conduct, Booking Agreement, and Cancellation Policy, which are incorporated by reference. If there is a conflict concerning your activities as an Instructor, this Agreement controls.
2. Application, Credentials, and Verification
2.1 Application. You will submit accurate and complete information, including: legal name and any business name; instructor certifications (issuing organization, discipline, certificate number, and expiration date); state certifications or licenses required to teach any course you offer (for example, state-approved concealed-carry or permit courses); professional references; range or facility arrangements; and insurance information.
2.2 Review. An FMN administrator will review your application and may approve, deny, request more information, or revoke approval at any time at FMN's discretion. FMN may contact your references and certifying organizations.
2.3 Limits of verification. You acknowledge that FMN does not verify every claim and that approval is not an endorsement or certification. You alone are responsible for the truth and accuracy of every credential and claim on your profile.
2.4 Background-check status. Background checks are optional unless FMN requires them for a specific program (such as Youth Classes). If you obtain one through a screening provider or process FMN approves, you authorize FMN to display the resulting status and date on your profile. If FMN orders a background check, it will provide a separate disclosure and obtain your authorization as required by the Fair Credit Reporting Act.
2.5 Ongoing duty to update. You must update your profile within 7 days of any change, and notify FMN immediately at legal@firearmmentorshipnetwork.com of: any lapse, suspension, or revocation of a certification, license, or insurance policy; any arrest, charge, conviction, protective order, or other event affecting your legal eligibility to possess firearms; or any incident during your Training involving injury or a negligent discharge.
3. Eligibility Representations
You represent and warrant, on acceptance and on each use of the Platform, that:
- You are at least 21 years old;
- You are not prohibited under federal, state, or local law from possessing, receiving, or transporting firearms or ammunition;
- You are not subject to any protective order or pending charge that restricts firearm possession or contact with participants;
- You hold every certification, license, permit, and business registration you represent and that is required by law to offer each course you list;
- You have not been convicted of any offense involving violence, sexual misconduct, child abuse or endangerment, or unlawful use of firearms; and
- All information you provide is true, complete, and not misleading.
4. Independent Contractor Status — No Employment
4.1 Independent business. You are an independent business owner offering services directly to Participants. You are not an employee, agent, partner, joint venturer, franchisee, or legal representative of FMN, and nothing in this Agreement creates such a relationship.
4.2 Control. You alone determine whether, when, where, how, and to whom you provide Training; your curriculum, methods, schedule, class sizes (within the Platform's safety limits), rates, and equipment; and your own cancellation and refund terms (within the Cancellation Policy minimums). FMN does not direct or supervise your work and does not require you to accept any Training request.
4.3 No compensation from FMN. FMN does not pay Instructors and does not collect, process, hold, or remit payments for Training. You set your rates and collect payment directly from Participants using your own outside payment page or method. You are solely responsible for payment disputes, refunds, chargebacks, and the terms of your payment provider.
4.4 Taxes, licenses, and benefits. You are solely responsible for all taxes (income, self-employment, sales/use where applicable), business licenses, and registrations. You are not entitled to employee benefits, workers' compensation, or unemployment insurance from FMN. You are responsible for any workers' compensation coverage for your own staff or assistants.
4.5 Freedom to work elsewhere. You may advertise and provide services through any other channel, including competing platforms.
4.6 No authority to bind. You may not make any commitment on FMN's behalf or represent that FMN endorses, employs, or certifies you.
5. Insurance
5.1 Coverage. FMN strongly recommends that you maintain, at your own expense, commercial general liability insurance (or firearms-instructor liability coverage) covering your instruction activities, with limits of not less than $1,000,000 per occurrence and $2,000,000 aggregate.
5.2 Notice. You will notify FMN within 10 days if your coverage is cancelled, lapses, or is materially reduced. FMN may suspend your profile until proof of current coverage is provided.
5.3 No FMN coverage. FMN does not provide insurance for Instructors, Participants, or Training.
6. Compliance with Law
You will comply with all applicable federal, state, and local laws, regulations, and ordinances, including those concerning:
- Possession, carrying, transportation, storage, and use of firearms and ammunition, in each jurisdiction where you teach or travel;
- Sales, loans, and temporary transfers of firearms, including state laws that require background checks for private or temporary transfers and the limited exceptions for use at a range under supervision;
- Minors and firearms, including 18 U.S.C. § 922(x) and the requirement that a juvenile's handgun possession during a course of instruction be supported by prior written parental consent, and all state minimum-age laws;
- State requirements for certified instructors and approved curricula for carry-permit courses, and accurate representations about whether a course satisfies any permit requirement;
- Business, consumer-protection, advertising, accessibility, and privacy laws; and
- Range zoning, noise, and land-use rules where Training occurs.
You will not use the Platform to sell, transfer, or ship firearms, ammunition, or regulated items, or to facilitate any transaction prohibited by law. Any sale of ammunition or targets at a range is solely your (or the range's) transaction and must comply with law; it may not be advertised or arranged through FMN.
7. Range Rules and Facilities
You will conduct live-fire Training only at ranges or facilities that are lawfully operated and permit your activity, and you will:
- Obtain the range's permission and comply with its rules, waivers, hours, and RSO commands;
- Confirm the facility is suitable for the planned drills, firearms, calibers, and participant skill levels;
- Provide Participants with the location, arrival instructions, required equipment, and any range-specific waiver in advance; and
- Never conduct live fire on property where you lack permission or where it would be unsafe or unlawful.
8. Firearm Safety Rules and Standards of Instruction
You will comply with the FMN Safety Policy and, at a minimum:
- Enforce the universal firearm safety rules at all times;
- Conduct a safety briefing before every hands-on or live-fire session, including emergency procedures and the location of trauma/first-aid supplies;
- Keep live ammunition out of classroom and dry-practice areas; use inert training rounds for manipulation drills;
- Inspect firearms and equipment you supply and remove any that are unsafe;
- Require eye and ear protection during live fire;
- Maintain appropriate instructor-to-student ratios (1:1 or 1:2 for new shooters on the firing line; 1:1 for Minors) and use qualified assistants where needed;
- Remove anyone who appears impaired, unsafe, or legally prohibited;
- Teach only subjects within your qualifications and the scope of your certifications;
- Carry a trauma kit with a tourniquet and have an emergency action plan; and
- Report incidents to safety@firearmmentorshipnetwork.com within 24 hours.
9. Classes, Bookings, Attendance, and Reviews
9.1 Accurate listings. Course listings must accurately describe content, prerequisites, duration, location, equipment requirements, total cost (including range fees and ammunition), capacity, age eligibility, and cancellation terms.
9.2 Honoring bookings. You will honor confirmed bookings and follow the Cancellation Policy. Repeated Instructor cancellations or no-shows may result in suspension.
9.3 Waitlists and attendance. You will promptly manage waitlists and mark attendance accurately. Attendance records may be relied on by Participants for their records; never mark attendance or completion that did not occur.
9.4 Certificates. Issue completion certificates only for Training actually completed, and only under the standards of the certifying organization.
9.5 Reviews. You may respond professionally to reviews but may not solicit or pay for reviews, offer incentives for positive reviews, or retaliate against reviewers.
9.6 Provider waivers. You may require Participants to sign your own waiver in addition to FMN's acknowledgments, provided you disclose it before booking. FMN's documents do not replace your own risk-management documents.
10. Youth Classes
You may list Youth Classes only if approved by FMN for youth instruction. You must: accept Minors only through a Guardian booking with completed Parent/Guardian Consent; obtain and keep any written consent required by law; communicate only with the Guardian; ensure the Guardian (or a designated adult as permitted by the Parent/Guardian agreement) is present or responsible as required; never be alone with a Minor out of view of another adult; never transport a Minor; and use age- and size-appropriate firearms and equipment.
11. Data and Communications
You may use Participant and Guardian information obtained through the Platform only to provide the booked Training and related communications, and must protect it with reasonable safeguards. You may not add Participants to marketing lists without their consent, sell their information, or share Minor information with anyone. Keep communications professional; messages may be moderated.
12. Intellectual Property
You retain ownership of your course materials. You grant FMN a license to display your profile, listings, photos, and logos on the Platform and in Platform promotion. You represent you have rights to everything you post.
13. Release and Indemnification
13.1 Release. To the fullest extent permitted by law, you release FMN and its members, managers, officers, employees, and agents from claims arising out of your Training or your interactions with Participants, Guardians, ranges, or third parties.
13.2 Indemnification. You will defend, indemnify, and hold harmless FMN and its members, managers, officers, employees, agents, and sponsors from all claims, losses, damages, liabilities, fines, penalties, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your Training or any act or omission of you or your assistants; (b) bodily injury, death, or property damage connected with your Training; (c) any claim that you are FMN's employee or agent, including claims for wages, benefits, or taxes; (d) your breach of this Agreement or any Platform Policy; (e) your violation of law; or (f) misrepresentation of your credentials, insurance, or eligibility.
14. Term, Suspension, and Termination
This Agreement continues until terminated. You may terminate by closing your Instructor profile, after honoring or properly cancelling existing bookings. FMN may suspend or terminate your Instructor status, remove listings, or cancel classes at any time, including for safety concerns, complaints, lapse of credentials or insurance, or violation of this Agreement. Sections 4, 11, 12, 13, 15, and 16 survive.
15. Disclaimers and Limitation of Liability
The disclaimers, limitation of liability, and dispute-resolution provisions of the Terms of Service apply. FMN makes no promise of any minimum number of Participants or bookings.
16. General
This Agreement is governed by the laws of the State of Alabama, with venue as set out in the Terms of Service. FMN may amend this Agreement on 30 days' notice. You may not assign this Agreement without FMN's written consent. Electronic acceptance is binding.
